Overview

Efficient debt recovery
for creditors

Unpaid debts represent a real cost to any business or individual. The longer a debt remains outstanding, the more difficult recovery becomes. Prompt, well-executed legal action is often the most effective way to recover what is owed and to signal to debtors that outstanding amounts will be pursued.

I have extensive experience in debt collection, having served on the creditor panels of BMW Financial Services (South Africa) and NDC Credit Management earlier in my career. I bring the same systematic, results-focused approach to all debt collection mandates, from single disputed invoices to portfolios of outstanding accounts.

My approach is to move efficiently through the collection process, keeping costs proportionate to the amount being recovered and keeping clients informed at each stage. Where a debtor has genuine defences or disputes the debt, I advise honestly on the prospects and the most cost-effective path forward.

How It Works

The debt collection process

Letter of Demand
A formal attorney's letter of demand is issued to the debtor, requiring payment within a specified period. This often prompts payment without further legal action and places the matter on a formal legal footing.
Summons
If the demand is not met, summons is issued and served on the debtor. The debtor then has an opportunity to defend the claim. Where the debt is clear and undisputed, most debtors do not defend.
Default Judgment
Where the debtor fails to defend, a default judgment is obtained from the court. This is a formal court order confirming the debt and entitling the creditor to enforce payment.
Asset Investigation
Before enforcement, the debtor's assets and employment status are investigated to identify the most effective enforcement mechanism. This avoids wasting costs on enforcement against debtors with no realisable assets.
Enforcement
Enforcement is carried out through the most appropriate mechanism: a warrant of execution against movable or immovable property, a garnishee order against salary, or other available remedies depending on the debtor's circumstances.
Recovery
Funds are recovered and paid over to the creditor. Where the debtor pays in instalments under a garnishee order, I monitor compliance and take further action if payments are missed.

What I Handle

Debt collection services

Letters of Demand
Formal attorney's letters of demand in respect of outstanding debts. A well-drafted demand from an attorney often produces payment without the need for court proceedings, saving both time and costs.
Summons & Default Judgments
Institution of proceedings by way of summons and obtaining default judgment where the debtor fails to defend. I handle both Magistrates' Court and High Court proceedings depending on the amount of the claim.
Garnishee Orders
Emoluments attachment orders directing an employer to deduct and pay over amounts from the debtor's salary. One of the most effective enforcement mechanisms where the debtor is employed and earning a regular income.
Warrants of Execution
Attachment and sale in execution of the debtor's movable or immovable property to satisfy an outstanding judgment. I advise on the most appropriate assets to attach and manage the execution process through to completion.
Defended Debt Matters
Where a debtor defends a claim, I conduct the litigation to judgment. I advise honestly on the prospects of success and the most cost-effective approach, including settlement where appropriate.
Portfolio Debt Collection
Systematic collection of portfolios of outstanding accounts for businesses and financial institutions. I bring an organised, efficient approach to volume debt collection, with regular reporting and cost management throughout.

Common Questions

Debt collection explained

What is the debt collection process in South Africa?
The debt collection process typically begins with a letter of demand, followed by issuing summons if the demand is not met. If the debtor does not defend the claim, a default judgment can be obtained. Once judgment is granted, enforcement steps such as a warrant of execution, garnishee order, or emoluments attachment order can be pursued to recover the debt.
What is a letter of demand?
A letter of demand is a formal written notice from an attorney requiring a debtor to pay an outstanding amount within a specified period, typically seven to fourteen days. It serves as a final warning before legal proceedings are instituted and is often sufficient to prompt payment without the need for court action.
What is a default judgment?
A default judgment is a court order granted in favour of the creditor where the debtor has been served with summons but has failed to enter an appearance to defend or to file a plea. Once granted, a default judgment can be enforced through various mechanisms including attachment of assets and garnishee orders.
What is a garnishee order?
A garnishee order, also known as an emoluments attachment order, is a court order directing the debtor's employer to deduct a specified amount from the debtor's salary each month and pay it directly to the creditor. It is one of the most effective enforcement mechanisms where the debtor is employed.
How long does debt collection take?
The timeframe depends on whether the matter is defended and the court in which proceedings are instituted. An undefended Magistrates' Court matter from letter of demand to default judgment can be completed within two to three months. Defended matters take considerably longer. Enforcement after judgment varies depending on the debtor's assets and circumstances.
