A Case Study: Negligence and Liability in Retail Spaces.

In the case of Matlou v Big Save (Pty) Ltd, the incident involving a piece of timber falling on a customer's foot underscores significant concerns surrounding negligence and liability in retail spaces. Matlou, a 69-year-old resident of Hammanskraal, was injured while shopping at a grocery store in February 2019. The circumstances of her injury raise critical questions about the responsibilities of retailers to maintain safe environments for their customers.

The central issue in this case revolves around whether Big Save fulfilled its duty of care. Matlou claimed that the timber, left dangerously unattended, caused her injury due to the store's negligence. In contrast, Big Save denied liability, suggesting that an unknown third party inadvertently caused the timber to fall. However, the evidence presented indicated that the timber's presence in a customer area was hazardous and unjustifiable, highlighting a failure on the part of the store to ensure safety.

Video footage played a pivotal role in the court's decision, showing that the third party did not exert excessive force when bumping into the timber. This evidence suggested that the timber had not been properly secured, undermining the defendant’s argument. Furthermore, the reliance on disclaimer notices posted at the store entrance was dismissed by the court; no clear proof was provided regarding their wording or visibility to customers, thus failing to absolve the store of responsibility.

Ultimately, the case serves as a compelling reminder of the obligations retail establishments have toward their clientele. By not ensuring a safe environment, Big Save was found liable for Matlou’s injuries. The outcome highlights the legal expectations placed on businesses to prioritize customer safety, as well as the limitations of disclaimers in mitigating liability. Consequently, Matlou was awarded full compensation for her damages.
